Who provides the service

EMWaver Lab is provided by Luís Pedro Soares Marnoto Gaspar Lopes, NIF 241286506, Qta da Penha Longa, Aldeamento C, Casa 31, 2645-103 Alcabideche, Portugal, trading as EMWaver. Contact: [email protected].

Subscriptions are sold through Link, operated by Stripe, which acts as reseller and merchant of record. Link charges your payment method, collects VAT where it applies and issues your receipts and invoices, under its own terms that you accept at checkout. These terms govern the service itself.

The service

You describe the electronics you want and connect a supported board to your computer. EMWaver SI, an AI agent, writes firmware and a web page for it, compiles the firmware on our servers, and gives you a page that flashes and talks to your board through your browser (WebUSB, Web Serial). Each app you create is kept in your account with its own chat.

The agent is software and makes mistakes. Check what it builds before you rely on it, and never use it for anything safety-critical, medical, or where a failure could injure someone or damage property.

Your account

You sign in with your email address and a one-time code. Keep access to that email secure: whoever can read it can use your account. One account is for one person; do not share it.

Price, billing and the monthly allowance

The subscription is €20 / month, VAT included where it applies, billed in advance each month from the day you subscribe until you cancel. The current price is on the pricing page. If we change it, we tell you by email at least 30 days before your next charge at the new price, and you can cancel before then.

Each month includes a usage allowance for the agent’s work, shown as a percentage in Settings. When it is used up, the agent pauses until your next billing month; everything you have built keeps working and stays available. The allowance does not roll over.

If a payment fails, Link retries it. If it still fails, building stops until the subscription is paid; your apps are kept.

Cancelling, withdrawal and refunds

You can cancel at any time in Settings → Manage billing. Cancelling stops the next charge; you keep access until the end of the month already paid for.

14-day refund. If you live in the EU you have a 14-day right to withdraw from a digital service contract. Because the service starts as soon as you subscribe, at checkout you ask us to start it straight away. Whatever the legal position, we offer this: within 14 days of your first payment, email [email protected] and we refund that payment in full and end the subscription. Later monthly payments are not refunded, except where the law requires it or the service was unavailable through our fault.

Your content and your code

What you write to the agent, the files you upload, and the firmware and pages built for you are yours. We use them only to run the service for you: we do not sell them and we do not use them to train models. You give us the permission needed to store, compile and serve them for that purpose.

Code the agent writes may include open-source components under their own licences, which you must respect when you distribute it.

Acceptable use

Do not use EMWaver Lab to:

• break the law, including radio-spectrum rules: transmitting where you have no right to is illegal;
• access, clone or interfere with devices, cards or systems you do not own or have permission to use;
• build malware, or attack, probe or overload our servers or anyone else’s;
• get around the monthly allowance, or resell access to the service.

We may suspend an account that breaks these rules. Unless the breach is serious or the law forbids it, we tell you first and give you a chance to fix it, and we refund any month you paid for and cannot use.

Your hardware

Flashing firmware changes your board. A wrong build can stop it working until it is re-flashed, and wiring mistakes can damage parts. You flash at your own risk; we are not responsible for boards or parts damaged by firmware you chose to flash, except where the damage is caused by our negligence.

Availability and changes

We aim to keep the service running but cannot promise it will never be interrupted. We may improve or change features; if a change takes away something substantial you are paying for, you may cancel and we refund the unused part of the month.

Liability

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer. Otherwise our total liability to you is limited to what you paid in the 12 months before the claim, and we are not liable for losses that were not foreseeable.

Ending the service

You can cancel at any time and ask us to delete your account and data ([email protected]). If we stop offering EMWaver Lab, we give at least 30 days’ notice, refund any unused prepaid time, and let you download your apps first.

Complaints and disputes

Write to us first at [email protected]. You can also use the Livro de Reclamações Eletrónico or, out of court, the CNIACC (www.cniacc.pt). Other consumer dispute entities are listed at www.consumidor.gov.pt.

Governing law

These terms are governed by the law of Portugal. If you live elsewhere in the EU, you keep the protection of the mandatory consumer law of your own country.
